ASSET TURNOVER IN CONTROLLED
SUBSTANCE VIOLATIONS

A RESOLUTION OF THE UTAH INTERCOLLEGIATE ASSEMBLY TO THE
UTAH STATE LEGISLATURE AND THE UTAH COUNCIL OF STUDENT BODY PRESIDENTS RECOMMENDING THAT
ALL MONETARY GAINS OR EQUIVALENT THEREOF, RESULTING FROM MUNICIPAL ACQUISITION IN
CONTROLLED SUBSTANCE VIOLATIONS ON ALL GROUNDS GOVERNED BY INSTITUTIONS OF HIGHER
EDUCATION IN THE STATE OF UTAH, BE TURNED OVER TO THE RESPECTIVE INSTITUTION TO AID
CAMPUS-WIDE DRUG EDUCATION RELATED PROGRAMS.
WHEREAS, drug use and abuse is a growing
problem each year in the State of Utah and the United States of America and;
WHEREAS, Salt Lake County, Salt Lake
City, the University of Utah and South Salt Lake are all members of the Drug Enforcement
Agency's Salt Lake Metro Task Force and;
WHEREAS, from the beginning of FY 1995 to
the current date, Metro DEA alone has acquired $xx,xxx,xxx from asset forfeitures and
turnovers relating to controlled substance convictions and;
WHEREAS, the Utah State Legislature has
appropriated fewer monies every year for controlled substance abuse prevention and
education within institutions of higher education on their respective campuses and;
WHEREAS, Metro DEA does not give a
significant portion of their funds to Utah institutions of Higher Education.
THEREFORE, BE IT RESOLVED that the Utah State Legislature
see a need for more controlled substance prevention and education funding.
THEREFORE, BE IT FURTHER RESOLVED that Utah Metro DEA
include police or patrol forces from all campuses of higher education in the State of
Utah.
THEREFORE, LET IT BE FINALLY RESOLVED that the Utah State
Legislature enact legislation allowing all monies or equivalent thereof, found or seized
on campuses of higher education in the State of Utah, be remanded to the respective
institution for the use of controlled substance abuse prevention and education. |
